Important data updates for the third sector
There are two important data updates for the third sector following changes introduced by the Data (Use and Access) Act 2025, which came into effect in February 2026.
The first is that all charities must have a process in place for handling data protection complaints by Tuesday 19 June 2026. These new requirements are set out in the Data (Use and Access) Act and mean organisations must establish a clear process for managing complaints relating to data protection, although some exemptions apply.
The second update relates to direct marketing, allowing charities to send electronic communications — including emails, texts, and social media messages — to people who have expressed interest in, or support for, their charitable purpose, without needing prior consent in certain circumstances where strict requirements are met.
This change is expected to create new opportunities for the sector by providing charities with a further way to engage with individuals who have already shown genuine interest in supporting their work.
